The Federal Motor Vehicle Safety Standard FMVSS No. 205 clearly does not prohibit tint below 70%. Read it! After all, most States require conformance with FMVSS205, but still permit tinting as low as 30%.
If police are unable to point out where in the PA STATUTE, the Regulation, or the Federal Safety Standard tint below 70% is prohibited, then they should not illegally detain, threaten, or cite vehicles.
Because both TITLE 75 of PA STATUTES - 4524 (e)(1) - The PA sun-screening LAW and the PA ADMINISTRATIVE CODE TITLE 67 - CHAPTER 175.67 (d)(4), the code written to clarify the law, specifically ALLOW ANY TINTING permitted under FMVSS205, many PA police are desperately hoping to find something in here that restricts tinting below 70%.
Unfortunately, it simply isn't in here!
Even PENNDOT admits that no PA Statute prohibits tint permitted by FMVSS205, but they claim that it is "... the Department's interpretation that the FMVSS205 prohibits tint below 70%."
PA STATE INSPECTION GUIDLINES FOR WINDOW TINT
(i) Reject if any of the following apply:
(A) Approved safety glazing is not used in every windshield, window and wing.
(B) A sign, poster or other material whose design prevents a driver from seeing through the material, obstructs, obscures or impairs the driver’s clear view of the highway or an intersecting highway. Under FMVSS No. 205, this restriction does not apply to the rear side windows, rear wings or rear window of trucks or multi-purpose passenger vehicles.
(C) A sign, poster or other material, whose design prevents a driver from seeing through the material, extends more than 3 1/2 inches from the lowest exposed portion of the rear window, rear side windows or rear wings of a passenger car.
